1. Acceptance of Terms

By accessing, browsing, or using the services provided by PACE Motor Group Ltd. ("PACE", "we", "us", or "our") via our mobile applications or website at https://pacemotorgroup.com, you enter into a legally binding agreement and agree to comply with these Terms of Service. If you do not agree with any provision herein, you must immediately discontinue use of the platform and services.

2. Driver Eligibility & KYC Verification

To ensure passenger and luxury fleet safety, every primary driver must satisfy our stringent eligibility criteria:

• Minimum Age: 21 years of age for Executive Sedans and Luxury SUVs; 25 years of age for high-performance Supercars (e.g. Porsche 911 GT3, Ferrari F8, Lamborghini Huracán).
• Valid Driving License: A valid, unexpired national driver's license or international driving permit held for at least two (2) consecutive years without major moving violations.
• Mandatory Identity Clearance: Drivers must complete our digital KYC verification by submitting photo documentation (license front/back or international passport) prior to vehicle release.
• Authorized Drivers Only: Vehicles may only be operated by the vetted and confirmed primary renter or designated secondary drivers explicitly endorsed in writing on the rental contract.

3. Reservations, Rates, Deposits & Escrow

Transparent pricing and financial security are foundational to our mobility experience:

• Daily Rental Rates: Daily rates cover a standard 24-hour cycle and include the baseline daily mileage allowance specified per vehicle tier. Excess mileage is billed at the prevailing per-mile rate upon vehicle check-in.
• Security Deposit Escrow: A pre-authorization security deposit hold (between $2,500 and $7,500 depending on vehicle tier) is captured prior to handover. Platinum VIP members may qualify for deposit reductions or waivers.
• Deposit Release: Upon safe return and post-rental mechanical inspection, deposit holds are released within three (3) to five (5) business days, less any authorized charges for fuel replenishment, excess mileage, or minor damage.
• Cancellation Windows: Cancellations submitted at least 48 hours prior to reservation pickup receive a 100% refund. Cancellations inside 48 hours are subject to a one-day rental cancellation fee.

5. Comprehensive Insurance & Damage Waivers

Every vehicle booking includes mandatory statutory liability coverage. Renters may select optional supplemental protection tiers during checkout:

• Basic Shield: Standard third-party liability with a $5,000 damage deductible.
• Premium Protection: Full comprehensive collision damage waiver (CDW) with a reduced $2,000 deductible, plus windshield and tire road-hazard protection.
• Platinum VIP Zero-Deductible: Total zero-deductible coverage, 24/7 dedicated executive roadside rescue, and guaranteed vehicle swap within 60 minutes in Greater Accra.
• Incident Reporting: Any accident, collision, or mechanical anomaly must be reported to the PACE 24/7 Concierge Desk within two (2) hours, accompanied by a police report where legally required.

6. Vehicle Telemetry, Digital Keys & Recovery

All vehicles in the PACE fleet are equipped with enterprise IoT telemetry systems:

• Digital Key Access: Verified renters receive dynamic digital keys inside the PACE mobile app for keyless lock, unlock, and trunk release during their authorized reservation period.
• Fleet Telemetry: Vehicle speed, odometer telemetry, fuel level, and geographic coordinates are monitored in real time for fleet safety, maintenance diagnostics, and emergency recovery.
• Remote Immobilization: In the event of theft, unauthorized cross-border movement, severe contract default, or dangerous reckless operation, PACE reserves the right to remotely disable vehicle ignition once stationary.

7. Electronic Signatures & Digital Enforceability

When confirming a vehicle reservation on the PACE platform, you provide your handwritten digital signature on a touch canvas. In accordance with the Electronic Transactions Act and international e-signature standards, you agree that your digital signature carries the same legal weight, validity, and enforceability as a physical pen-and-paper signature.

9. Limitation of Liability & Indemnification

To the maximum extent permitted by applicable law, PACE Motor Group Ltd. and its officers, directors, and affiliates shall not be liable for any indirect, punitive, incidental, or consequential damages resulting from vehicle operation, weather interruptions, or third-party roadway hazards. The renter agrees to indemnify and hold harmless PACE against any third-party claims arising from unauthorized drivers, willful misconduct, or violation of these Terms.

10. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the substantive laws of the Republic of Ghana. Any unresolved claim or controversy arising under these Terms shall be resolved through binding arbitration administered in Accra, Ghana, conducted in the English language.
